These Terms and Conditions (“Terms”) govern your use of the Cosmocost, LLC (“Cosmocost,” “we,” “us,” or “our”) website, online services, and the purchase of cosmetic products sold through the website (collectively, the “Website”). By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Website. PLEASE NOTE: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

International visitors may access and browse the Website; however, Cosmocost sells and ships products exclusively within the United States. Only customers physically located within the United States may place orders or receive shipments. By placing an order with Cosmocost, you represent and warrant that you are located within the United States at the time of purchase, that the shipping address provided is within the United States, and that you are not using a freight forwarder or forwarding service to circumvent these restrictions. Cosmocost does not ship internationally and does not accept international orders.

By accessing the Website or purchasing from Cosmocost, you represent that you are at least 18 years of age and have full legal capacity to enter into this agreement. You agree to comply with all applicable laws and regulations in connection with your use of the Website.

All content on the Website—including text, descriptions, graphics, images, branding, data, software, and all other materials (“Contents”)—is the property of Cosmocost or its licensors and is protected by United States copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Website for personal, lawful purposes only. You may not copy, reproduce, distribute, modify, create derivative works, sell, resell, mirror, scrape, harvest, reverse-engineer, decompile, or otherwise exploit any part of the Website or its Contents. Any unauthorized use automatically terminates your license and may result in legal action. Cosmocost reserves the right to suspend or terminate access to the Website at any time, with or without cause.

If you create an account, you are responsible for maintaining its confidentiality and for all actions taken under your login credentials. Cosmocost may refuse service, close accounts, or cancel orders at its sole discretion.

Cosmocost manufactures custom cosmetic products based on ingredient selections and percentages chosen by the customer. While Cosmocost uses good manufacturing practices and reasonable industry standards to create products that are safe, stable, and effective, you acknowledge and agree that ingredient combinations you select may interact unpredictably, may not be fully compatible, may not remain stable, may oxidize or degrade naturally over time depending on your ingredient choices, and may not deliver your intended results. Exact ingredient percentages may vary slightly due to standard cosmetic manufacturing tolerances, batching processes, raw material differences, and normal formulation variability, and such minor deviations do not constitute defects. You further acknowledge that Cosmocost cannot guarantee the performance, potency, longevity, irritation profile, or stability of any custom formulation because the active ingredients and percentages are determined by you.

You accept full responsibility for evaluating ingredient suitability, including the presence of any allergens, sensitivities, or adverse reactions, and you agree to thoroughly review all ingredient information prior to purchase. You additionally agree to perform a patch test before full application and to discontinue use if irritation occurs. All Cosmocost products are cosmetic in nature and are not intended to diagnose, treat, cure, or prevent any disease.

Order acknowledgments do not constitute acceptance; your order is accepted only after payment is processed and the product is shipped. Pricing may change at any time without notice and promotional adjustments are not applied retroactively. Cosmocost reserves the right to cancel any order due to payment issues, incorrect information, inventory limitations, suspected fraud, or concerns regarding ingredient combinations. If Cosmocost cancels an order, you will receive a refund for any amount paid.

All custom products are made specifically to your specifications and are non-returnable and non-refundable except in cases of manufacturing defects, fulfillment errors, or damage incurred during shipping. To qualify for a replacement or refund, you must notify Cosmocost in writing within seven (7) days of delivery and provide sufficient documentation of the issue. Cosmocost products are intended for personal use only and may not be resold or redistributed without prior written authorization. Gift cards are delivered electronically, are non-refundable, and may be deactivated if fraudulent activity is suspected.

All products and Website services are provided “AS IS” and without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, expected performance, accuracy, stability, or durability. Cosmocost does not warrant that the Website will operate without interruption or error. To the fullest extent permitted by law, Cosmocost shall not be liable for any damages arising from or related to your use of the Website or products, including but not limited to allergic reactions, irritation, adverse results, ingredient incompatibilities, reliance on product descriptions, storage conditions, misuse of products, inaccurate information provided by you, or improper handling or application. Your sole and exclusive remedy for dissatisfaction with any product is limited to the purchase price of that product.

The Website may contain links to external third-party websites. Cosmocost does not endorse, control, or assume responsibility for any third-party content, policies, or practices. You access third-party websites at your own risk.

You agree to indemnify and hold harmless Cosmocost, its owners, employees, affiliates, contractors, and agents from any claims, losses, liabilities, damages, expenses, or legal actions arising out of your misuse of the Website, violation of these Terms, negligence, failure to follow product instructions, or reliance on ingredient selections chosen by you.

Cosmocost makes no representation that the Website or its content is appropriate or lawful outside the United States. If you access the Website from outside the U.S., you do so at your own initiative and assume all responsibility for compliance with local laws.

These Terms are governed solely by the laws of the State of Michigan, without regard to conflict-of-law principles.

Any dispute arising out of or relating to your use of the Website or the purchase of products must first be submitted to Cosmocost at support@cosmocost.com for informal resolution. If the dispute cannot be resolved, it shall be submitted to binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. You waive the right to participate in any class action, collective action, private attorney general action, or consolidated proceeding, and you waive the right to a jury trial. You may opt out of arbitration by sending written notice to support@cosmocost.com within thirty (30) days of first accepting these Terms. If you do not opt out, arbitration is mandatory.

If any provision of these Terms is deemed invalid or unenforceable, the remainder shall remain in full force. Failure by Cosmocost to enforce any right does not constitute a waiver of that right. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cosmocost.
